These terms and conditions (‘the Terms’) govern the users (‘you’ or ‘your’) use of the website SITE URL (‘the Website’) and your relationship with Banner Carpets and Flooring (Banner Carpets, Quin Road, Ennis, ROI) whose registered office is at Riverside Retail Park, Quin Road, Ennis, ROI.

(‘we’, ‘our’, or ‘us’). Please read them carefully as they affect your rights and liabilities under law. If you do not agree to these Terms, please do not access nor use the Website. If you have any queries regarding these Terms then please contact us.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Cardholders responsibility regarding jurisdiction laws

The cardholder shall remain responsible for notifying their issuing bank with any changes in details or fraudulent/not normal activities on their account. Bannercarpets.ie takes no responsibility regarding any fraudulent activity on any customers cards/accounts used on this website. We have taken all necessary steps regarding upholding PCI DSS compliance and remain objective in the case of cardholders bearing their own responsibility regarding jurisdiction laws.
Relevant Law
This Agreement shall be constructed in accordance with Irish Law and the parties submit to the exclusive jurisdiction of the Irish Courts.

Delivery Timeframes:

Items shipped via AnPost or other courier service will be dispatched within 1-3 business days subject to stock levels.

Additional Delivery option may be available depending on your location. These Options include Next-day services and economy services.

Our standard shipping methods are fulfilled via AnPost and DPD Ireland.

Items that are bought via our showroom and include fitting, will be delivered on the day of fitting.

COVID-19 Delivery Information

In response to COVID-19, all our carriers are taking precautionary measures to ensure the health and wellbeing of their drivers and our customers.
Please be assured that all our carriers are following the advice and guidelines from the government and that the safety of everyone is our priority.
There is currently no impact to our delivery services at this stage, however we encourage all customers to use your home address for delivery.
Moving forward all carriers will operate a contact free delivery service which means that you won’t be required to sign for any parcel that’s delivered.
You can see all carrier guidelines and measures upon visiting the nominated carrier website, emails will be provided upon dispatch to confirm delivery information.
We hope that you understand and appreciate the measures that have been implemented are to protect you and ensure we can continue to operate as normal.

What personal data do we collect about you?

We collect personal data from you when you provide it to us directly and through your use of the Site. This information may include:

You do not have to provide this information to us, and can delete it or update it at any time.

Who do we share this personal data with?

We share customers’ personal data with third parties in the following circumstances:

    • With our professional and legal advisors.

Storage and Retention

We use service providers based around the world. Consequently, your personal data may be processed in countries outside of Europe, including in countries where you may have fewer legal rights in respect of your data than you do under local law. If we transfer personal data outside the European Economic Area we will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate safeguards, in particular the EU’s standard contractual clauses. We will keep your personal data for as long as we need it for the purposes set out above, and so this period will vary depending on your interactions with us. For example, where you have made a purchase with us, we will keep a record of your purchase for the period necessary for invoicing, tax and warranty purposes. We may also keep a record of correspondence with you (for example if you have made a complaint about a product) for as long as is necessary to protect us from a legal claim. Where we no longer have a need to keep your information, we will delete it. Please note that where you unsubscribe from our marketing communications, we will keep a record of your email address to ensure we do not send you marketing emails in future.

Security

This Site ensures that data is encrypted when leaving the Site. This process involves the converting of information or data into a code to prevent unauthorised access. This Site follows this process and employs secure methods to ensure the protection of all credit and debit card transactions. Encryption methods such as SSL are utilised to protect customer data when in transit to and from this Site over a secure communications channel.

Whilst we do everything within our power to ensure that personal data is protected at all times from our Site, we cannot guarantee the security and integrity of the information that has been transmitted to our Site.
Children

Our Site is not intended for, and should not be used by, children under the age of 18. We do not knowingly collect personal data from children under 18.

What rights you have over your data

update these Terms from time to time and any changes will be notified to you via a suitable announcement on the Website. It is your responsibility to check for such changes. The changes will apply to the use of the Website after we have given such announcement. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms; and modify or withdraw, temporarily or permanently, this Website and the material contained within (or any part) without notice to you and you confirm that we shall not be liable to you for any modification to or withdrawal of the Website or its contents.

Price and Payment

All prices shown are inclusive of VAT (only where applicable – see below) at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to you.

If your delivery address is within the United Kingdom, no additional taxes will be charged to you. If your delivery address is outside of the United Kingdom you may be subject to import duties and taxes (including VAT), which are levied once a delivery reaches your destination country. Any such additional charges must be borne by you. You should note that customs policies and practices vary widely from country to country. We recommend that you contact your local customs office for information.

Please note that when shipping goods from outside the United Kingdom, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of the United Kingdom, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.

Payment can be made by any major credit or debit card or via our site. Payment will be debited and cleared from your account before the dispatch of your good or provision of the service to you.

In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order in accordance with clause 9, we are not required to sell the goods to you at the price shown. We always try and ensure that the prices of goods shown on our Website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund.

You confirm that the credit, debit card or PayPal account that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us we will not be liable to you for any delay or non-delivery.

If your credit or debit card payment is not processed successfully for any reason, we reserve the right to reattempt to process payment within 48 hours. In the event that the payment is still unsuccessful, we will give you at least 48 hours’ notice in advance of any further reattempt to process payment by sending an email to the email address you have provided to us. If you do not want us to reattempt to process payment, you must cancel your order in advance.

You may only use one discount code with each order. We reserve the right to reject or cancel any orders where you add more than one discount code to the basket.

We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value.

Please familiarise yourself with these terms and conditions before you place an order as we reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged. If there is any inconsistency between the terms and conditions upon which the discount codes were issued and these terms and conditions, the discount code terms and conditions prevail. A copy of the discount code terms and conditions can be obtained by mailing or telephoning our customer service representatives

Delivery

Various delivery options will be offered at checkout subject to address and region of delivery.

Please note your registered card address and your delivery address must match.

Returns

In order to ensure our customers receive the best level of service and are happy to indulge their sweet tooth we offer a comprehensive returns policy in the unlikely event that you are not 100% satisfied with sweets delivered. Please note that the following returns procedure must be followed, and failure to do so may result in us being unable to exchange goods or provide refunds. Also please be aware that we cannot be held responsible and provide refunds/exchanges on stock affected by circumstances beyond our control. This includes damage and neglect after goods are received, goods being stored in climatic conditions such as extremes of temperature that can affect some items – items often stick together or alter appearance slightly, but will taste the same and damage by third parties. In addition please be aware that during the hot summer months goods in transport can be effected by the heat so be aware that delicate items such as chocolate may not always look as intended, but they will of course still taste as good as ever.

Should you wish to return an item for any reason please notify us within 48 hours of receipt of your order of any part that is unsatisfactory. In order to arrange a return, please contact us and inform our customer service team of your order number, the item you are returning and the reason for the return.

We will then reply with a unique returns authorisation number and the address you need to send the item to.

You’ll need to package the item securely and include:

Your order number
The returns authorisation number
Whether a replacement or refund is needed
The reason why you are returning the item.

Goods returned should be in their original condition and packaging in which they arrived, along with a copy of the invoice or packing slip.

Once received items will be checked and refunds on goods and postage arranged where suitable. We cannot issue refunds on simply unwanted goods due the perishable nature of goods on sale. Refunds/exchanges will only be offered on items that are faulty, and were clearly so at the time at which they were dispatched.

Your access to and use of Bannercaprets.ie (the website) is subject exclusively to these Terms and Conditions. You will not use the app for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the app you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the app.

 

2. CREDIT CARD DETAILS

All Bannercaprets.ie purchases are managed facilitated through Paymentsense.com and Bannercaprets.ie will never store your credit card information or make it available to any third parties. Any purchasing information provided will be processed directly from you to Paymentsense.com and you will be subject to their credit card policies.

 

3. LEGAL ADVICE

The contents of Bannercaprets.ie do not constitute advice and should not be relied upon in making or refraining from making, any decision.
All material contained on Bannercaprets.ie is provided without any or warranty of any kind. You use the material on Bannercarpets.ie at your own discretion

 

4. CHANGE OF USE

Bannercaprets.ie reserves the right to:

General

 

 

  1. A contract for supply of goods shall only exist when an order has been placed by customer and accepted by the Company and the deposit has been paid.

 

  1. We reserve the right to reject any order whereby a pricing error has occurred due to human error.

 

  1. Deposits are non-refundable once an order has been placed.

 

  1. Whereby a deposit is paid by credit card, we reserve the right to hold card details in the event of non-payment within the agreed timeframe.

 

  1. Banner Flooring Ltd retains ownership of all goods supplied until the customer has made payment in full.

 

  1. Banner Flooring Ltd is not responsible for any losses in relation to late or non-supply of goods not caused by the company.

 

Flooring

  1. We do not take back / offer refunds on non-stock flooring box orders. We do offer a credit note in terms of flooring stock items purchased.
  2. Upon collection / delivery of flooring you will be asked to sign a collection / delivery docket. Banner Flooring Ltd accept no liability for any damage subsequently reported.

 

Carpet

 

  1. All rooms MUST BE CLEARED in advance of fitting of sheet flooring i.e. carpet, vinyl.Fitters are entitled to leave any premises if this is not seen to be the case upon arrival.  Fitting may be delayed by up to 3 weeks subsequently.
  2. Door Trimming –

Doors may need to be trimmed to allow sufficient clearance for your carpet and underlay depending on the depth of product you have chosen.  This is not part of the fitting service provided unless specifically agreed with the fitter.  The fitter may remove doors to facilitate fitting and leave them aside for you or your carpenter to carry out the trimming and re-hanging required.

If you have fire doors, external doors or non-wood doors that require trimming, this will need to be carried out by a specialist carpenter and this is not a service which Banner Flooring Ltd will either carry out or arrange. We are also unable to remove, or arrange the removal of, any fire doors or external doors so arrangements must be made prior to the fitting date to avoid any delays.

 

  1. Uplift & Disposal of Existing Floorcoverings must be arranged prior to the agreement of a fitting date.This arrangement and payment of same will be between the fitter and the client.  Fitters are self-employed and will only undertake the removal of same upon agreement of price.

 

  1. Damage and scuff marks

Fitters undertake to carry out their work with reasonable skill and care, but even with the greatest care home décor may be marked or scuffed during the fitting process. New paintwork and wallpaper are especially vulnerable and should be allowed to fully dry. A minimum of two weeks is recommended. Neither Banner Flooring Ltd nor any fitter undertake to carry out any redecoration, except where damage has been caused by that person’s negligence.

 

  1. Subfloor

Our home flooring surveyor and subfloor preparation

We will only carry out and take responsibility for any free survey where the product to be installed is subsequently purchased from us.

If you have asked for a Banner Flooring surveyor to visit your home and check the suitability of a particular product to be supplied by us for your flooring, the survey is limited to checking what is physically visible without lifting existing floor coverings. If you would like the entire subfloor checked, it is your responsibility to lift the existing floorcoverings prior to inspection.

Following inspection, we will advise of any works that may be necessary prior to the installation of your product as revealed by the survey of the subfloor. You can then decide whether you wish for a fitter recommended by us to carry out any subfloor preparation under a separate agreement between you and the fitter, or whether you wish to arrange to carry out any appropriate works yourself.

If you elect to carry out any subfloor preparation works, it is your responsibility to ensure that the works are completed to an appropriate standard in accordance with the manufacturer’s instructions for the product(s) used.  You will need to provide the store arranging the fitting with evidence that this has been completed prior to the fitter attending to fit the floorcovering.

  1. Post Fitting

Please inspect the completed work with your fitter before they leave. Your fitter should be able to address any issues which are identified.

If a problem with the fitting manifests itself after the product has been fitted, please either contact your fitter directly or in the first instance, let the store know if there are issues.

 

Flooring Underlay

 

2mm – 3mm Foam

 

Typically white, it is manufactured generally from Polyethylene.  This is a basic underlay designed to take stress off the joints where the boards meet.

Usage                            – low traffic areas

Sound reduction   – Minimal

Our take               – Its grand like!!

Price range           – €0.75 – €1.00 per square metre (25 metre rolls)

 

4mm – 5mm Foam

 

May carry a gold or silver foil back with overlapping flaps. Designed for acoustic reduction

 

Usage                   – heavy traffic areas

Sound reduction   – 21 – 23db reduction

Our take                       – Over priced – generally it just a thicker version of the standard foam and also made from Polyethylene.  Issues can arise where it is compressed over time.  It tends not to bounce back and we have moved away from it

Price range                   – €3.00 – €3.50 per square metre (10sqm – 15sqm rolls)

 

2mm – 3mm Rubber Acoustic Reducing Underlay

 

This product is designed to soften the sound of footfall on your floors.  Highly recommended in timber-frame houses where hordes of children may be roaming free and untethered throughout your upstairs.  You’ll still hear them, just not as much as before – bless their cotton socks.

Usage                           – Heavy traffic areas

Sound Reduction           – 21 – 23db reduction

Our take                       – Best seller and an excellent, trouble-free product.  Though only 2mm thick it is a very solid and heavy product.  It lays flat of it’s own accord and its rubber composition ensures no compression unlike its Polyethylene equivalent.

Price Range                   – €3.00 – €4.00 per square metre (10 sqm rolls)

 

5mm Rubber Acoustic

 

This is the momma of them all with properties that make it more solid than Padraig Harrington on the back nine of a major on Sunday.  So heavy they had reduce the roll size to 8 sqm so as not to make grown men look like weaklings.

 

Usage                   – Anywhere you want

Sound reduction   – 28db

Our take                       – If it’s within your budget and you can dead lift a small calf then it’s the one for you

Price Range           – €8.00 – €9.00 per square metre (quantity dependant)

 

2mm Heatwise

 

A must for underfloor heating systems.  Its perforated rolls allows heat to pass through easily and evenly

 

Usage                            –  Under any underfloor heating system

Sound reduction   –  Minimal

Our take               –  Your only man

Price Range           –  €3.00 – €3.50 per square metre (quantity dependant)
